The
September 2005 timeframe of Jackson
and Kelly's Agreement
had passed. The agreement provisions were not
attempted.
I would
receive a drawing
from Platinum Properties in October of 2005. It was a rough drawing from
Triad Engineering, showing a large rock blanket. I
could not get a response from Platinum Properties after that.
CityNet is an occupant of building 113 Platinum Drive; which adjoins our property.
CityNet is
communications company that had
the same analogous
owners as Platinum
Properties. Said company needed to utilize the Lacaria property for their
placement of a singular communication
service cable.
I contacted
CityNet, who
quickly arranged a meeting at the fence line area.
In addition to
myself, the meeting was attended by an engineer with Triad
Engineering and two Laurita
Construction
Supervisors. The Triad Engineer apologized several times. He had never
seen the agreement until then. (He should
have, as the agreement was based on is conclusions). My concerns
was the diversion of Platinum Properties
drainage away from our property, and the appearance of the
access road.
Laurita
Construction wanted to
address the
water drainage
issues and
wanted to move the property line fire hydrant located at 113 Platinum
Drive to the
other side of Platinum Properties
parking lot area.
(At the time, I was only aware of the surface water issues from the
parking lot area, knowledge of underground drainage came later).
The Triad Engineer was
adamant about getting the
work
started as soon as possible. Laurita
Construction, wanted to wait until drier weather. They finally agreed
amongst themselves to perform the
work
during the drier spring and
summer months ahead. Hand shakes with the understanding that it was
shortly going to be corrected.
Though nothing was done. It would later be realized why the Triad
Engineer was so adamant. Thrasher Engineering had allowed Building 109
Platinum Drive to be built over a coal seam. Thus; it had a documented
history of drainage induced floor raisings.
Compounding the Problem; Thrasher Engineering's and City of
Bridgeport's Allowed Locust Post Grid Fence Line Lateral Support, was
not a locked in feature.
In a few months, in the latter part of 2006; Platinum's undersized
parking lot drainage lines would be crushed closed. The drains
succumbing to the doughy fill and the heaver garbage trucks. The
drainage that had been coming down into our property backed up and
reversed course back to building 109 Platinum Drive's underlying coal
seam. Their Building blew up out of the ground as the drainage
had found another outlet area.
